USER AGREEMENT

In using the BodyJewell.com shopping service, of BodyJewell, you (The User) are deemed to have accepted the terms and conditions listed below. The Company reserves the right to add, delete, alter or modify these terms and conditions at any time. The User is therefore advised to read carefully these terms and conditions each time he or she uses the shopping service(s) of The Company .

All products/services and information displayed on this website Shopping constitute an "invitation to offer". Your order for purchase constitutes your "offer" which shall be subject to the terms and conditions as listed below. The Company reserves the right to accept or reject your offer. The agreement between you and The Company shall be subject to the following terms and conditions :-

The User certifies that he/she is at least 18 (eighteen) years of age or has the consent of a parent or legal guardian.

These terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted. By using the Shopping services of The Company you agree to be bound by the Terms and Conditions.

All prices, unless indicated otherwise are in US Dollars.

All prices and availability of products are subject to change without prior notice at the sole discretion of The Company.

All prices listed on this website are subject to confirmation. The Company will notify you by eMail within hours of making a purchase if the confirmed price of an item you have selected differs from the price listed on the website or on your purchase order. If you do not receive an eMail within 24 hours of completing a purchase order, Hbc is deemed to have confirmed the purchase at the price listed. If you receive such notification, the sale will be automatically terminated unless you reply by eMail with confirmation of your intention to purchase the item at the confirmed price.

The Company reserves the right to refuse or cancel any order placed for a product that is listed at an incorrect price. This shall be regardless of whether the order has been confirmed and/or payment been levied via credit card. In the event the payment has been processed by The Company the same shall be credited to your account and duly notified to you by email.

The Company reserves the right to limit the quantities of certain items which you, your family or any group can purchase. The Company will use commercially reasonable efforts to deliver items as quickly as possible and within any time periods indicated.

In a credit card transaction, you must use your own credit card. The Company will not be liable for any credit card fraud. The liability to use a card fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively on the user.

In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address) any extra cost incurred by The Company for redelivery shall be claimed from the User placing the order.

The Company shall not be liable for any delay / non-delivery of purchased goods by the vendors, trade organisation/s, manufacturers / shop etc. (vendors), flood, fire, wars, acts of God or any cause that is beyond the control of The Company.

All products are duly screened and assured by the vendors to ensure that the products are of the standard, quality, composition, style or model that they represent.

The User agrees to use the services provided by The Company, its affiliates, consultants and contracted companies, for lawful purposes only.

The User agrees to provide authentic and true information. The Company reserves the right to confirm and validate the information and other details provided by the User at any point of time. If upon confirmation such User details are found not to be true (wholly or partly), The Company has the right in its sole discretion to reject the registration and debar the User from using the Services of the website's Shopping, and / or other affiliated websites without prior intimation whatsoever.

The Company will not be responsible for any damage suffered by users from use of the services on this site. This without limitation includes loss of revenue/data resulting from delays, non-deliveries, missed deliveries, or service interruptions as may occur because of any act / omission. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorised access to, alteration of, or use of record, whether for breach of contract, tortuous behaviour, negligence, or under any other cause of action.

This agreement shall be construed in accordance with the applicable laws of Sri Lanka. The Courts at Colombo shall have exclusive jurisdiction in any proceedings arising out of this agreement.

Refunds

Please choose carefully as we do not offer a refund simply because you have changed your mind.

We believe that we accurately describe the products in our online store and that the photos of our individual pieces of jewellery display the colour with a reasonable degree of accuracy. However, the colour that you see on your computer screen depends on a number of factors including the colour quality and settings of the computer screen that you are using. Also, our stones and pearls may reflect different colours depending on the light.

As we use natural stones and pearls in our sterling silver jewellery you need to be aware that there may be some colour variations within the stones and pearls and that some will have natural inclusion. Any inclusions are not flaws and in many cases these are evidence that the stones and pearls are not man-made. We believe that inclusions enhance the natural beauty of our products.

You should also be aware that a lot of our sterling silver jewellery is hand made and therefore you should expect variations that are inherent in jewellery that is not mass produced. Again, we believe that such variations enhance the natural beauty of our sterling silver jewellery. Please note that the piece of jewellery shown in the photograph may not be the exact piece that you receive, however, the dimensions and quality of the piece will be similar. As our jewellery is handmade there will be individual variations within similar pieces. If you would like to see a photograph of the exact piece that you will be receiving we will be happy to e-mail a copy to you - simply send us an e-mail to sales@bodyjewell.com requesting a photograph.

Any request for cancellations of orders once duly placed on the site, shall not be entertained. Please note certain goods cannot be returned unless we are at fault.
